When applying for a Work Permit, evidence must be provided that a Labour Market Needs Test has been undertaken for the vacancy. To comply with the Labour Market Needs Test requirement the employer must advertise the vacancy with the FÁS/EURES employment network for at least eight weeks and in local and national newspapers for at least six days.
Applications should not be submitted unless the Labour Market Needs Test has been completed.
FÁS Procedures
Employers should log onto FAS Jobs Ireland to register for the online service. Alternatively, employers should call FÁS National Call Centre on 1800 611 116 to register their vacancy by phone.
An employer registering a vacancy on FÁS Jobs Ireland and the EURES Service must specify that the vacancy is a potential work permit application. If the employer fails to do this, it will not be possible at a later stage to acquire a work permit to fill the vacancy.
The vacancy the employer has registered will be given a reference number and the employer will be sent notification by post of the details they have registered.
Very Important Follow-Up
The employer must contact their local FÁS office (contact details are included in the notification received from FAS) after eight weeks if they have been unable to source an Irish or EU national and request that a decision is made on the vacancy they have advertised. At this point, FÁS will review the number of enquiries which have been made about the vacancy and, bearing in mind the specifics of the local labour market, will determine whether a work permit is justified in order to fill the vacancy.
This review is conducted at the request of the employer. If the employer does not contact FÁS after eight weeks, the advertisement will continue to run but no work permit determinations will be made. Under these circumstances no work permit can be issued for this vacancy.
