Appointments to the Employment Appeals Tribunal

Mr Tony Killeen, T.D., Minister for Labour Affairs, has made appointments to the Employment Appeals Tribunal with effect from 30 January 2007 for a 3-year period. The three year term of office of all except the Chairman of the Tribunal expired on 29 January 2007. The Minister reappointed 79 existing members, and appointed 36 new members. With the objective of increasing the available pool of experience to the Tribunal, the number of Vice-Chairmen has increased from 31 to 35 and the number of members nominated by bodies representative of employers and by ICTU has increased from 36 to 40 each.

The Minister said: “I am deeply grateful to all the members of the outgoing Tribunal for their commitment and service to the State in this important body within the employment rights framework. I am sure that the contribution of the new members will build on this. The increase in numbers, as well as a revision of Tribunal procedures which I have set in train, should enhance the service to the customers of the Tribunal around the country.”

The Employment Appeals Tribunal is a quasi-judicial body. Its function is to adjudicate on disputes involving individual employment rights. It has jurisdiction under fourteen Acts of the Oireachtas and two Statutory Instruments to deal with individual employment rights disputes that arise either during the course of employment or on the termination of the employment relationship.

The Tribunal currently consists of a Chairman and 31 Vice-Chairmen and a panel of 72 other members, thirty-six nominated by the Irish Congress of Trade Unions and thirty-six by organisations representative of employers. The total number will be increased by 12 from 30 January 2007. This will increase the pool of experience available to the Tribunal, in order to support an enhanced service to the public.

The Tribunal acts in Divisions, each consisting of either the Chairman or a Vice-Chairman and two other members, one drawn from the employers’ side of the panel and one from the trade union side.

  • Unfair Dismissals Acts 1977 to 2005 [disputes under this Act account for 95% of the work of the Tribunal];

  • Protection of Employees (Employers' Insolvency) Acts, 1984 to 2003;
