Consultation on the Review of the Patents Act 1992
This consultation is engaging with interested parties, including patent applicants/proprietors and to those acting as agents, and seeking their views for inclusion in the review of the Patents Act 1992 (as amended).
The review is examining the current legislative framework in order to establish key issues for deliberation, with a view to bringing a proposal for legislative changes to Government for approval. The review will focus, in particular, on the process for the granting of national patents and the protection of these rights once granted to align these procedures further with international standards and practice.
Consultation on the Application of Directive 2004/48/EC of the European Parliament and the Council of 29 April 2004 on the enforcement of intellectual property rights
The EU Commission issued its Report on the application of Directive 2004/48/EC on the enforcement of intellectual property rights (5140/11) on 10 January 2011 together with an accompanying working document (5140/11 ADD 1) containing a more detailed analysis of the Directive’s application in the Member States.
Member States are invited to present their views on the contents of the Report before 31 March 2011. This feedback is to assist the Commission in conducting a thorough impact assessment in preparation of an eventual amendment of the Enforcement Directive and any other future measures concerning the enforcement of intellectual property rights.
Interested parties may submit their contributions direct to the Commission. The Department of Enterprise, Trade and Innovation would be interested in receiving a copy of any submissions. Consultation on fees charged for Supplementary Protection Certificates
The Department of Enterprise, Trade and Innovation is conducting a review of the fees charged for Supplementary Protection Certificates. The consultation is intended to engage with interested parties to seek their views on the proposal to review the current application and renewal fees for Supplementary Protection Certificates. Responses should be received by close of business on Friday 30th July 2010.
