Services Directive Consultation Document
The Services Directive (Directive 2006/123/EC on Services in the internal market) was transposed in November 2010. The European Union (Provision of Services) Regulations. 2010 (S.I 533 of 2010) give effect to the Services Directive in Ireland, with the exception of Article 42 of the Directive, which has been transposed separately by the European Communities (Court Orders for the Protection of Consumer Interests) Regulations 2010 (S.I 555 of 2010).

Background
The Services Directive is one of the most important initiatives adopted by the EU in recent years. Its objective is to create a Single Market in commercial services in the European Union so that both businesses and consumers can take advantage of the opportunities it offers. The Directive must be transposed by 28th December 2009 and the Consultation Document shows in detail how this Department intends to transpose the Directive.
Introduction
The Consultation Document covers every article of the Directive and sets out the means by which it will be transposed. Some provisions are addressed to the European Commission and not to the member States. They are also covered in the Consultation Document.
The Consultation Document takes the form of an outline of the transposing legislation (a set of Regulations) with explanatory notes inserted after each draft Regulation. The Document should be read in conjunction the Handbook on the Implementation of the Services Directive.
The Department sought the views of stakeholders about a number of provisions in the draft of the Regulations. The deadline for receipt of comments was 30 September 2009. Please see below stakeholder replies regarding the draft regulations on the Services Directive.
